Enzhost Terms of Service

1. Ownership and Acceptance of Terms

EnzHost owns all editorial content and graphics on this site. EnzHost provides web services to subscribers all over the world, and all customers must abide by the following Terms and Conditions of Service. The terms of service listed below are intended to provide the highest level of service possible. This EnzHost Terms of Service agreement (hereinafter referred to as “TOS”) establishes the terms and conditions under which EnzHost’s Services (hereinafter referred to as “Services”) will be provided to you upon your registration. You confirm that you are at least 18 years old. The TOS clearly outlines what is and is not permitted with the Services. This TOS is not exhaustive, and EnzHost reserves the right to change it at any time, with notice posted at www.enzhost.com. No employee’s verbal or written agreement/statement, or anything on the EnzHost website, will take precedence over the TOS. The Customer agrees to all terms and conditions of the TOS, as updated from time to time, in their entirety by registering for and using any of EnzHost Services. The Customer is accountable for his or her clients if the Customer resells or represents the Services for which the Customer is paying. Only the Customer who is paying for the Services is recognized by EnzHost, not his or her clients. Violation of the TOS or any other inappropriate activity as deemed by EnzHost may result in the Customer’s Services being terminated or suspended.

2. Service Delivery Time

We provide our service instantly by sending an email to your registered email address and granting access to your EnzHost host dashboard. The entire process is automated. However, if the automation fails for any reason, it may take up to 24 hours to deliver the service.

3. New Accounts

We will set up your account once we have received payment and screened the order(s) for fraud by ourselves and/or our payment partner(s). You must provide us with an email address that is not @ the domain(s) under which you are registering. If there is ever an issue with abuse or if we need to contact you, we will use the main email address on file. You must keep the email address on file up to date and current at all times. You must ensure that the contact information for your domain account and your actual domain name(s) are valid and up-to-date if you have a domain name registered with EnzHost. EnzHost is not responsible for a lapsed registration caused by the domain being paired with outdated contact information. If you need to double-check or alter this information, go to your clients’ section and make the changes yourself. Your account may be terminated if you provide any fraudulent contact information. Within 3 days of establishing your account with EnzHost, you will be required to present government-issued identification (Passport/National ID/Driving License, etc.) and proof of address (Utility Bill) for any service purchased from EnzHost. If you do not meet these standards, your order may be flagged as fraudulent and refused. New account setup may be delayed due to unexpected challenges with multiple mail servers and any connection problems between your ISP and EnzHost’s operating office.

4. Transfers

Our migration staff will do everything possible to assist you in moving your site to us. However, our migration team provides transfers as a best-effort service, and we cannot guarantee availability, possibility, or time required to execute an account transfer. Each hosting firm is set up differently, and some hosting platforms save data in an incompatible or proprietary format, making migration of some or all account data exceedingly difficult, if not impossible. We will do our best to help you move data from a previous host, but we may not be able to do so in some situations. The free transfer services are available for a period of three (3) days after you sign up.

5. Satisfaction Guaranteed

Only the Web Hosting service is covered by a 30-day guarantee. If you are dissatisfied with the services for any reason during the first 30 days of service (Only Web Hosting), you may request that your services be terminated in writing via email or through our cancellation form (see below), and you will receive a full refund*. You must also provide a specific explanation for your cancellation (as we request any cancellation, regardless of the time frame). We are the sole arbitrators of whether your reason is valid and if you and we both took all reasonable steps to correct the problem that caused the interest to be canceled. No refunds will be approved if the client has broken the conditions of the agreement.

*Domain registrations/renewals/transfers or SSL, etc. + Processing fees will apply.

6. Payments

When you subscribe to our services, you are signing up for a pre-paid service, and all ITES (domain registration, web hosting, SSL, etc.) services are subject to 5% VAT or 5% VAT and 2% sales tax for web development services. All past-due invoices can be paid online with various methods including bKash, PayPal, as well as via bank transfer or walk-in payments at our operating office. Except for payments made through our offline method, all online payments are subject to a payment gateway fee, which will be added automatically when you select payment options in your Clients Area > Invoice. Renewal notices are sent multiple times via email from 30 to 1 day before the renewal date. If your yearly charge is declined and we are unable to contact you, late fees will apply to authorize your account. The following steps will be taken if a shared/reseller/VPS/Dedicated/Email Server/Spam Filtering/File Hosting, etc. account has a past due invoice:

  • 1 Day: No Action Taken
  • 2 Days: Accounts are suspended
  • 7 Days: Late Fee Added
  • 15 Days: Accounts will be terminated

7. Cancellations

You must write to sales or request a Cancellation from your clients’ area if you wish to cancel your services.

8. Overage Charges

Given our customers’ needs, our service plans are designed to accommodate the majority of usage scenarios. Your consumption, however, may differ and necessitate additional resources, particularly in storage and traffic. If your account requires more resources, we will never charge your card automatically. You must keep your email address up to date so that you can receive an email when your account reaches specific limits set entirely by our system, at which point you can contact us to upgrade your account’s transfer quota. If your allotments are exceeded and you do not contact us, the system will suspend your site.

9. Refunds/Accounts Termination

If EnzHost fails to provide said services for any reason, a prorated refund will be granted. If EnzHost is forced to suspend or terminate your services due to a violation of our stated policies, no refunds will be given. If you request account cancellation, your account will be suspended once your service has been canceled. It will be deleted within 30 days. If your account is suspended for any other reason and remains suspended for more than 10 days, it will be erased. If a customer has multiple accounts with EnzHost, EnzHost reserves the right to suspend all accounts if one or more accounts are not paid until all payments are made. No refunds will be given if you are found to be in breach of our terms and conditions. If you use our service for the second time, there will be no refund. It is only given to a buyer once for any product.

10. Content

All EnzHost services must be used for legitimate purposes only. Any information, data, or content that is sent, stored, or presented in violation of any local laws is prohibited. This includes copyrighted information, material we deem threatening or obscene, material that threatens national security, and material protected by trade secrets or other laws. The subscriber agrees to indemnify and keep EnzHost harmless from any claims arising out of the subscriber’s use of EnzHost services that hurt the subscriber or anyone else. Any content that is deemed illegal, threatening, or culpable (in written form, visual form, or inferred) is not tolerated. We want you to manage your material and be in charge of what your website offers. We do not have the resources or time to regularly monitor and manage our servers.

11. Prohibited Content Includes (but is not limited to):

  • IRC Scripts/Bots
  • Proxy Scripts/Anonymizers
  • Pirated Software/Warez
  • Image Hosting Scripts
  • AutoSurf/PTC/PTS/PPC sites
  • IP Scanners
  • Brute-force Programs/Scripts
  • Mail Bombers/Spam Scripts
  • Banner-Ad Services
  • File Dump/Mirror Scripts
  • Commercial Audio Streaming
  • Escrow/Bank Debentures
  • High-Yield Interest Programs or Related Sites
  • Lottery Sites
  • Hateful/Racist/Harassment oriented sites
  • Hacker-focused sites/archives/programs
  • Sites promoting illegal activities
  • MLM/Investment websites/apps

Shared Web Hosting Accounts are not permitted to be utilized as a backup/storage (files/database dump/file sharing media, etc.) device. A shared web hosting account is exclusively for the storage of websites, not for remote file storage. If we find such storing activity, it will be seen as a violation of the EnzHost TOS, and the account will be suspended or terminated immediately. The VPS/Dedicated Server plans have no restrictions regarding backup/storage.

12. Resource Usage Policy

EnzHost reserves the right to monitor resource usage and capacity on all accounts. Any account consistently using over 20% of system resources may be notified and required to upgrade their service.

13. Security

EnzHost systems may be monitored for any lawful purpose, including ensuring compliance with policies, administering systems, and maintaining security. Any account found engaging in unauthorized access will be suspended immediately.

14. Opt-in Email Marketing

You may engage in email marketing only through opt-in consent from recipients. Sending unsolicited bulk emails is prohibited and may lead to account suspension.

15. Spam Policy

Unsolicited Commercial Email (UCE) and Unsolicited Bulk Email (UBE) are strictly prohibited. If you send spam, your account will be immediately suspended.

16. System Abuse

Any attempt to undermine or damage the operations of EnzHost is strictly prohibited. This includes but is not limited to unauthorized access, probing, scanning, and malicious actions.

17. Limitation of Liability

EnzHost is not liable for any direct, indirect, incidental, consequential, or special damages resulting from the use or performance of services provided.

18. Modifications

EnzHost reserves the right to modify the TOS at any time without prior notice.

19. Refusal of Service

EnzHost reserves the right to refuse, cancel, or terminate services at its sole discretion, particularly in instances of non-compliance with this TOS.

20. General

Service is subject to interpretation and change at the discretion of EnzHost management without notice. All charges are non-refundable and non-negotiable, except as specifically outlined herein.

By using EnzHost services, you acknowledge that you have read, understood, and agree to these Terms and Conditions of Service.
